6. explain legal and ethical constraints and the role of regulatory bodies

Regulatory Bodies

Ofcom: Ofcom deals with complaints by the viewers on such things like radio, television, internet, tele coms and postal sectores. If people you or anyone else have a complaint about any content of these types of media you can write or ring them. I did an example of one, writing a letter to ofcom explaining my complaint of coronation street.

Press complaints commission: They control newspapers and their advertising. They are  incharge of dealing with your complaints about newspaper's and their advertising. An example of this would be if someone had an complaint about an offensive news paper.

ASA: Regulator of advertising. Their role is to control all advertising across media.

BBFC: Film and video game classification. Their role is to make sure games and films are suitable for their ratings and the public eye in general.

letter of complaint to ofcom

Dear mr/mrs/miss at OFCOM
I am writing a letter as a complaiont about the episode of coronation street. This was on 16nth January 2012, I was appauled by the attack btween Owen and Fays. As coronation street have shown before watershed, I don't apreciate the story it has created and it should not have been showed. Even though the show is shows to wide audience, they should of thought the content and be more careful about the regulation. i am hugely unsatisfied that it could be even represented in this way.I apreicate that this done
for enteratinment and trying to connect to audience but i think is tottally unaceptable.
I think this is very offensive because in 2005 there was a law brought out that you can not hit anyone else's child unless they're your own as long as it doesn't leave a mark. Allowing parents to still punish children without taking it too extreme measures. In this story line Owen hits his girlfriend's adopted daughter because she poisoned his fish. This has shown a very violent and completely over reacted scene. The story line was very vicious and so i hope you understand my concern and review my issue with this episode.

your sincerely

Ruhee Ali

The PCC - Press complaints commision.
They are a organisation that deal with newspapers, magazines and newspaper websites. They don't cover things subjects such as advertisements, books, blogs and you also have to be connected to the story to be able to make an official complaint.

Examples of each one
Sensationalism - London Riots
The london riots would be a good example. This is becasue it causes a large sense of violence

Libel - The sun tells us that Beynce's baby isnt really Jay Z's.
This is a good example as it is made up and so it isn't true but its about a celebrity so that people would want to read about it as they believe its true,

Inaccurate reporting - Adele has cancer.
This was reported however it wasn't true as the actual problem was loose skin particles in her throat.

Offensive material - Look how much wait cheryl cole has put on (disgusting photo)
This would be considered offensive material as she will be offeneded and its a photo to cause reaction from the public.

Privacy and Paparazzi - Justin bieber swears at paparazzi.
This would be a good example as he is being annoyed by the paparazzi and they are taking advantage of the mood that he is in to make him look bad.

Negative Representation - Kim Kardashian's wedding is over after only 72 days.
They havent told her side of the story and it makes her look extremely bad.

Public right to know - Harry and caroline are back on.
This isn't a right for the public to know but because they want it thats what the papers give them.

On the PCC website (http://www.pcc.org.uk/complaints/makingacomplaint.html) it shows the 5 steps to make a complaint. Here is a screeenshot of that section.

Legal and ethical constraints, and the role of regulatory bodies

Copyright:

Copyright:is a legal concept, enacted by most governments, giving the creator of an original work exclusive rights to it, usually for a limited time. Generally, it is "the right to copy", but also gives the copyright holder the right to be credited for the work, to determine who may adapt the work to other forms. This is important because it shows that people wont taking anoyone else's material without their permisson. Also its the person's material, so it wouldn't be fair if someone takes their material without their persmssion. In audio visual soaps can't put music on without copyright. Also in newspaper and soaps needs to meet this so that people can  not take informaiotn of them and rip them of. If eastenders or the sun newspaper logo was taken it would have been taken without the permisson thats against the law.

Performing rights:
They have the right to perform music in public. This is part of the copright law and the demands which they have to pay to the music's composer/lyircs and publisher . THis is good because they can still perofrm their music but they would have permission and get a certain amount. In soaps this mean the actor in the soaps can perform the music in publice. Soaps need to have licence so that they can record the shows. and newspapers have this so that they can publish stories in a certain ways.

Royalties: Royalties: .are usage-based payments made by one party (the "licensee") to another (the "licensor") for the right to ongoing use of an asset. Royalties are typically agreed upon as a percentage of gross or net revenues derived from the use of an asset or a fixed price per unit sold of an item of such, but there are also other modes and metrics of compensation. Soaps and newpspaer both have to pay this to keep the conpanies running otherwise if they fail to pay they can be shut down.

Libel: A printed article that is shown to be a fact and puts someone in a negative image which is untrue. This is a constraint on what can be printed in the paper. An example of  this would be if celebirites  was being a negative pay which is their main problems. Also with

the actors and actresses in soaps.

Equal opportunities: Evereyone is treated the same as evereyone else and they would be allowed the same oppertunities as evereyonelse and not because of there race or anything else. This is a constraint as it is hard to let everyone benefit from everything. Newspaper this would giving a fair article so that no one is hurt by it. Also with soaps putting a fair storlyine so that no one is treated unfairly.

Broadcasting act: Laws on broadcasting. This is a constraint on what can be done and shown. In newspaper this is important so that they can have certain things published such as the topless photo of kate middleton which is forbidden and with soaps mean that they can show certain things and certain times. However soaps have certain things that they can;t show so it isn't broadcast. for example hollyoaks isn't broadcasted during the day because it would have scene  that might affect people but its on at a later day so that the older people can watch it

Accuracy: Making sure the information is a fact. So the information is the truth and there is no incorrect information. This is a important  since you have to be make sure not to offend or having a  biased opinion. An example of this would be if newspapper having the wrong information about the someone when it isn't. They could be sued for so they needs to make sure that the information is correct before publishing. Soaps need to make sure that the storyline is accurate so that it wouldn't be offensive to the viewers like in coronation street of Tyrone abuse storyline, they had to make sure it was accurate os that it wouldn't be offended and people can from it.

Offensive material: Shows or articles that cause offence to its viewers.  You would not to make sure that the information that doesnt have offensive material. An example of this would be in the soap of corronatoin street. when owen hit his foster child when its not biologically his child. This contained offensive material. Also an example of newspaper is when they published graphical images on the london rito which contains offensive material.

Sensationalism: Sensationalism is a type of bias writing in mass media in which events and topics in news stories and pieces are over-hyped to increase viewership or readership numbers. An example would be the london riots in 2010 because it images of violence and contains that could affect someone. In Eastender it would be the fire at the queen's vic since it contain graphical images that people wouldn.t be comfortable with.

Chequebook journalism:  is the form of journalism where the essential characteristic is that the journalist pays the subject of the work money for the right to publish his story. An example of this would be an australian soaps 'Frontlilne' which is used frequently. another example when Alex fuergoson selling a story of prince andrew but sold it to the wrong people. THis was to get the wrong ifnormation about him.

Privacy: Privacy is when an individual or group to seclude themselves or information about themselves and thereby reveal themselves selectively. An example of this would be the newspaper writing stories about celebrities and they don't get any privacy. That it their many problem in the society is that the celebrity don't get any privacy. Soap doesn't really have problem with privacy but more with the celebrity such as Ronnie Mitchell in eastender who getting so many complaints such as the baby swap storyline.

Representation: representing is someone to who they are. Representing is changing their mind about people. For example in print  people publish celbrities can have a bad representation in the media because of the stories that are published about them. Also in soap teenage can represented in a bad way because in soaps they are represented as bullies or violence.

Censorship: Censorship is the suppression of speech or other public communication which may be considered objectionable, harmful, sensitive, or inconvenient as determined by a government, media outlet, or other controlling body. An example of this would be during the war times, the reporters couldn't say many information. Also in soaps there were certain they couldn't say such as swear words.

Public right to know: The public deserving to know the truth to a certain extent. This is important that you don't want to cause worry or fear. This can be also known as freedon of speech. Howether in newpsper in the early 19's reporter couldn't post the truth about stories as they do now. Now they want to give viewers the truth so they give out the corret articles. However in soaps it can cause bit of a problem because hospital and police can say whats happening which can cause a stir.
